1. Introduction
Welcome to SwapAm ("we," "our," or "us"). These Terms and Conditions govern your use of the SwapAm platform, including our website, mobile application, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Definitions
- "Swapper": Any individual who registers an account to use the SwapAm platform to swap smartphones.
- "Vendor": Any individual or business that registers an account to offer smartphones for swap on the SwapAm platform.
- "Swap": The exchange of smartphones between Users and Vendors, facilitated by SwapAm.
- "Platform": The SwapAm website, mobile application, and related services.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use a strong password (a combination of upper and lower case letters, numbers, and symbols) for your account.
4. Code of Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law
- Violate or encourage others to violate the rights of third parties, including intellectual property rights
- Post or transmit any content that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, or otherwise objectionable
- Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
- Use any robot, spider, crawler, scraper, or other automated means to access the Service
- Bypass measures we may use to prevent or restrict access to the Service
5. Smartphone Swaps
SwapAm facilitates the swapping of smartphones between Swappers and Vendors. We do not guarantee the condition, quality, or authenticity of any smartphone listed on our platform. Swappers and Vendors are responsible for verifying the condition of smartphones before completing a swap.
All swaps are subject to our escrow payment system. Payment will be held in escrow until both parties confirm satisfaction with the swap. SwapAm charges a 2% processing fee and a 15% service fee on the agreed swap price, which is deducted when the payment is released to the Vendor after a successful swap.
6. Payments
All payments on the SwapAm platform are processed through Mobile Money in Ghana Cedi (GHS). By using our payment system, you agree to comply with the Mobile Money provider's terms and conditions.
SwapAm is not responsible for any issues with payment processing that are beyond our control, including but not limited to network outages, processing delays, or account restrictions.
7. Disputes
If a dispute arises between a Swapper and a Vendor regarding a swap, SwapAm will make reasonable efforts to help resolve the dispute. Swappers must report any issues with a received smartphone within 24 hours of receipt.
SwapAm reserves the right to make the final decision in any dispute, which may include refunding the payment, releasing the payment to the Vendor, or taking other appropriate action.
8. Limitation of Liability
To the maximum extent permitted by law, SwapAm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party
9. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Service, or updating the "Last Updated" date at the beginning of these Terms.
Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
